At Genifai (“we,” “our,” or “our company”), privacy and data protection are core to our values. This Privacy Policy explains how we collect, use, process, and protect personal data when you (“Merchant”) install and use the Saport application (“the App”) on your Shopify store, as well as how we handle the data of your store’s customers (“End Users”).

We operate as a data processor on behalf of Shopify merchants. By using our App, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

To provide our services effectively, we collect the following types of information:

A. Information Collected from Merchants

  • Shopify Store Information: Store name, domain, email address, physical address, and store settings necessary to integrate our App.
  • Store Content: Product catalogs, FAQs, and store policies used to customize the App for your store.

B. Protected Customer Data (End Users)

When End Users interact with the App on your Shopify store, we access certain Protected Customer Data via standard Shopify APIs to provide features like order tracking, returns handling, and personalized support. This may include:

  • Contact Information: Customer name, email address, and phone number.
  • Order Information: Order history, purchase details, delivery status, and tracking numbers.
  • Chat Data: The contents of the messages sent via the chat interface by the End Users.

We strictly adhere to data minimization principles, only accessing the exact customer data required to fulfill the specific support request in the chat.

2. How We Use the Data

We use the collected data strictly to provide and improve our services to you:

  • Providing the Service: To operate the chat interface, answer End User inquiries, and facilitate automated store interactions.
  • Service Customization: To personalize and optimize the service specifically for your store. Note: Your data and your End Users’ chat histories are never shared with or used to train models for other merchants.
  • Analytics: To provide you with chat performance metrics and insights into customer interactions.
  • Compliance: To comply with Shopify’s Partner Program Agreement and applicable legal requirements.

3. Data Sharing and Disclosure

We do not sell, rent, or trade yours or your customers’ personal data. We only share information in the following limited circumstances:

  • AI Service Providers: To generate AI responses, we use trusted third-party AI service providers. Important: Your customer data and chat histories are strictly processed to generate immediate responses and are never used by our AI providers to train public or external AI models. The data is not retained by them beyond the immediate processing period required to fulfill the request.
  • Infrastructure & Monitoring Providers: With trusted infrastructure partners (e.g., secure cloud hosting) and error monitoring tools required to operate the App safely. When using error monitoring tools, any sensitive personal data is automatically masked or redacted before transmission.
  • Shopify: Information is synced back to Shopify to execute actions requested by the End User (such as adding items to the cart or initiating a return).
  • Business Transfers: If Genifai is involved in a merger, acquisition, or asset sale, your data may be transferred. We will provide notice before your data is transferred and becomes subject to a different Privacy Policy.
  • Legal Obligations: If required to do so by law or in response to valid requests by public authorities.

4. Tracking Technologies

We use standard web technologies to maintain active sessions, ensure security, and provide essential functionality for both Merchants and End Users. We strictly use these technologies for operational purposes and not for cross-site tracking or targeted advertising.

5. Data Retention

We retain Protected Customer Data and chat histories only for as long as necessary to provide the services to the Merchant, or as required by law.

As a Shopify merchant, you have the ability to request the deletion of your account and associated data. In accordance with Shopify’s data protection requirements, we automatically process standardized data deletion requests and permanently remove customer data from our active systems following account closure or upon receiving a data erasure request.

6. Data Security

Genifai uses industry-standard security protocols to protect all data. All communications between the App, your Shopify store, and our servers are encrypted using modern cryptographic protocols (SSL/TLS). We implement strict access controls and continuous security monitoring to safeguard your data.

7. Your Rights

We respect your rights over your personal information and take reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your data. If you are a Merchant and wish to exercise these rights, please use the contact information provided below. We may require verification of your identity before processing such requests.

If you are a Merchant’s customer (End User) and wish to exercise your data rights, please contact the Merchant you interacted with directly. We serve as a data processor on their behalf and will support the Merchant in fulfilling your request through standardized Shopify data tools.

8. International Data Transfers

Our app and its associated data are processed and stored on servers that may be located outside of your jurisdiction. By using our App, you agree to the transfer, storing, and processing of your information in these locations.

9. Children’s Privacy

Our services are generally intended for Shopify merchants and are not directed to individuals under the age of 16. We do not knowingly collect personal information from children without appropriate verified parental consent. If we become aware that we have collected such data without verified parental consent, we will take immediate steps to delete that information from our servers.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify you by updating the “last updated” date at the top of this policy and, where appropriate, by other methods.
